Below are the Terms and Conditions that govern your use of this website and interaction with Scoot Tribe LLC. Any customer who visits our website or makes a purchase (online, offline, or in store) are subject to these terms and conditions. Please read them carefully and understand that use of this website constitutes your agreement to be bound by these Terms and Conditions.

Privacy Policy:

We recognize that you may be concerned about the collection, use and disclosure of personal information you are asked to divulge when purchasing from or browsing this website. In order to provide better service, we may ask for personal details such as your name, address telephone number or e-mail address. Privacy law requires us to collect personal information about you only from you if it is reasonable and practical to do so. Personal information is protected from unauthorized access, loss, misuse, discloser or alteration. Sensitive payment information such as credit card details are not stored on the internet, but is immediately encrypted and direct to a third party payment gateway. Generally, you have no obligation to provide any information requested by us. If you choose to withhold requested information, we may not be able to provide you with the goods and services that are dependent on the collection of that information, particularly if the collection of that information is required by law.

ScootTribe LLC may use the information you provide for the purpose of e-mail marketing. This information will assist us in providing better service to you and keeping you informed of new items and future promotions.

Your information will not be disclosed in any way outside of the primary functions of ScootTribe's operations and will not be sold or distributed unless:

- It is required by law.
- Records indicate that an individual may be engaged in illegal behavior such as but not limited to, fraud.

Credit Card Charge-backs

By purchasing a product from Scoot Tribe you waive your right to chargeback your credit card under any circumstance and will handle any and all issues in accordance to each of our policies. The chargeback process is expensive and time consuming for the merchant and issues can be resolved in an efficient matter by allowing our team to work with you. The first step is always to contact us.

Changes and Inaccuracies

Scoot Tribe constantly makes improvements to our website and we always strive to provide the most accurate product information to our customers. This includes:

- item details and specifications

- price

- product photographs

- dimensions

Sometimes, we do receive inaccurate information about a product from manufacturers. If you are buying something on our website and are concerned the description is inaccurate, please contact us before making your purchase. 

 

Price Changes

It is important to note that manufacturers will lower and raise prices from time to time due to exchange rates and tariff policies. We work hard to keep our prices up-to-date with those of the manufacturers. 

There are no refunds or reimbursements if prices change after you have placed your order. Scoot Tribe is not responsible for typographical, technical or descriptive errors. ScootTribe reserves the right to cancel any order for any reason, including errors in pricing.

 

State Laws on Motor Vehicles

Please check your states laws regarding vehicle emission regulations prior to making a purchase from Scoot Tribe to ensure your vehicle complies with state laws. We are not responsible if your vehicle cannot be licensed and/or registered.

 

Vehicle and Parts Manufacturer Warranty

All products and parts sold on our website or in store are covered by a manufacturer parts warranty that will be facilitated through Scoot Tribe. Warranty coverage terms by manufacturer can be find on the manufacture's website or an employee at Scoot Tribe. Any extended warranty purchased follows the same terms outlined by the manufacturer warranty. In the event a repair is being made outside of ScootTribe's repair center, we recommend only allowing licensed and/or authorized technicians to handle ANY repair the vehicle may need to avoid any physical harm, vehicle crash, and/or any additional damage to the vehicle that may be a result of improperly repairing the vehicle. Scoot Tribe is NOT responsible for any vehicle repair or part replacement performed on the vehicle including any repairs performed by the customer and/or licensed and authorized technician or dealership. 

Warranty is void in following circumstances:

- Extreme riding, racing, or competition riding

- Vandalism or theft

- Fire

- Accident; whether at fault or not at fault

- Unauthorized and/or unlicensed repair/assembly

 

Shipping Policy & Delays

All orders placed online are usually processed and shipped within 1-3 business days from the date of purchase. Rush processing orders will typically ship within 24 business hours. Scoot Tribe will contact you if an item is not in stock, and will not be in stock to ship within 7 days of order date. If you provide a shipping address that differs from your billing address, we will require a billing address verification and your order may be delayed until verification is processed. 

It is possible that delays out of the control of Scoot Tribe will occur. Such delays include: delays caused by shipping companies (trucks break down, wreck occurs, delays at shipping terminals, etc.), and delays caused by inclement weather and other acts of God. 

If a delivery driver is unable to deliver the vehicle(s) at the intended address due to road conditions, unpaved roads, no turn around point for the driver, or the driver and/or truck could be at harm, the shipping company will reschedule the delivery to a new designated meeting location that is safe for the driver and truck to get to. Typically the new meeting location will be at the end of the street that the customer lives on and the driver will assist in loading the vehicle(s) onto the customer's vehicle.

Scoot Tribe uses third party LTL transportation companies to deliver vehicles, and Fedex/USPS to deliver parts and accessories. LTL Transit time may take, but is not limited to, 2-8 business days depending on your address and its distance from the nearest distribution center. During holiday season (high processing and high volume for both us and trucking companies), transit times can be impacted causing an 4-12 business days wait time. Orders cannot be canceled or refused due to extended transit schedules / wait times. We occasionally have excessive shipping charges from our LTL carriers to outlying states in the South East, North West, and North East. 

 

Shipping Damages/Lost Item(s)

Shipments cannot be refused for delivery. If you receive your item(s) in unsatisfactory condition due to shipment damage or are missing an item(s), you must still accept the shipment and note on the shipping BOL(bill of lading) the damage. You must also notify us within 2 business days of any damage. You may only refuse the vehicle if the shipment is severely damaged beyond repair or completely the wrong order. Box rips/tears, crate damage, and/or minor scratches/dents to the vehicle are NOT eligible reasons for refusing the delivery. If you refuse delivery for the reasons just previously mentioned, you could be responsible for all freight cost including additional additional fees charged by the freight company as well as a 20% restocking fee. 

If your item does not ship within 7 business days (excluding time waiting for customer to provide requested further information to ship product ), you can request to receive a full refund and cancel your order.

Once the product has been assembled, fueled, or used in any way, it CANNOT be returned for any reason. 

 

Returns/Refunds/Cancellations

If you want to return a vehicle or part, it must still be in the original crate/box in new condition, completely unopened, and be returned within 7 days of delivery. You will be liable for return shipping cost (original shipping cost to you is non-refundable) and a 20% of item(s) price for a restocking fee.

You can cancel your order and receive a full refund minus 3% cancellation fee within 24 hours of placing your order or up until your order has shipped (whichever is greater). Once the item(s) have shipped, a 20% restocking fee will apply in addition to shipping costs to return the item.

If you have received the wrong vehicle or part and/or the wrong vehicle color, you MUST notify us within 3 days of receiving your order. If you do not notify us within 3 days of this matter, we will not be able to send a replacement or accept it back for return.

Orders placed on layaway will only be able to cancel the layaway agreement within 3 business days of placing the order. After 3 business days all payments toward layaway are non-refundable as we reserve and hold the unit until the final layaway payment has been made.

For any returned vehicles, a refund will be processed once the item(s) has been received into our warehouse or we confirm the item has not yet shipped at all. Please allow up to 5 business days to receive your refund.

 

Waiver of Liability

By purchasing any items on this website, you acknowledge and agree to be above 18 years of age. You acknowledge and understand that riding any vehicle purchased from ScootTribe can be a dangerous activity that requires a level of skill. You understand that these activities can result in serious injury to the person as well as damages to property. You voluntarily assume any and all risk associated with loss, damage or injury while riding the vehicles sold on our website. You agree to release and forever discharge Scoot Tribe LLC or its parent company and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf and the manufacturer from any and all claims, actions, damages, liabilities, cost or expenses and attorney fees which are related to, arise out of, or are in any way connected to your participation or use of these vehicles, use of equipment or property supplied by Scoot Tribe or its parent company whether or not such claims, actions, damages, liability, cost or expenses are caused by the negligence of the seller, manufacturer or distributor. Scoot Tribe is not liable for any bodily injury or death resulting from failure to properly assemble the vehicle. It is the responsibility of the buyer to watch assembly videos, ask the seller any questions the buyer might have about assembling, and become fully knowledgeable on how to assemble the vehicle prior to assembling the vehicle. By this Agreement, it is your intention as the buyer to surrender and waive any rights to sue or exercise any legal rights to seek damages from Scoot Tribe LLC or its parent company and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf. This agreement shall be affecting and binding upon heirs, agents, personal representatives and assigns. You have carefully read and acknowledge that you understand and agree to all the Terms and Conditions. You have had the opportunity to ask any and all questions regarding this Agreement and the affect of the same. You are aware that by purchasing an item and sending/remitting payment for the item, you assume all risk, and waive and release certain substantial rights that you may have or possess. You therefore release all liability and waive all rights in regards to activities with any items purchased from Scoot Tribe LLC.

 

Breach of Contract

The Terms and Conditions here serve as a final and binding agreement between Scoot Tribe and you, the user/buyer. In the event of a breach of this contract, initiated by you, you agree to pay any costs associated with collection of payment due or removal from any Public Communication medium, any harassing, abusive, defamatory, threatening, hateful or offensive statements about, obscene or indecent language about, or images or other materials that violate the law regarding Scoot Tribe, its products or its employees caused by you; including but not limited to: collections fees, attorney costs, court costs and associated costs.

As Scoot Tribe headquarters is located in Fayetteville, Arkansas the legal venue will be enforced within the boundary lines of Washington County, Arkansas.
